How UK Child Maintenance Works in 2026

The UK Child Maintenance Service (CMS) calculates maintenance using the Child Support Maintenance Calculation Regulations 2012. The calculator mirrors the official gov.uk CMS tool. Five rate bands apply based on the paying parent's gross weekly income, with adjustments for shared care and other children in the household.

The February 2024 reform abolished the £20 CMS application fee and strengthened enforcement powers. No further rate changes in 2025–2026; consultation-based reforms are not expected to land before 2027–2028.

Frequently Asked Questions

CMS can only assess income up to £3,000/wk gross (roughly £156,000/yr). Above this cap, the receiving parent must apply to the family court for a "top-up order" under Section 8 of the Child Support Act 1991. The court can order additional periodical payments beyond the CMS maximum, based on the children's needs and the paying parent's wealth.
You can make a family-based arrangement (private agreement) at any amount you both agree. It's free and flexible. CMS becomes mandatory only if either parent requests it. Since February 2024, CMS applications are free — the £20 fee was abolished. CMS has two service levels: Direct Pay (CMS calculates, parents arrange payment) and Collect & Pay (CMS collects; fees apply to both parties).
CMS counts annual overnights. 52+ nights/yr (1 night/wk on average) triggers a 1/7 reduction. 104+ nights triggers 2/7. 156+ nights triggers 3/7. 175+ nights triggers 50% + an additional £7/wk reduction. Completely equal care (183+ nights) may reduce the liability to zero. Our calculator uses weekly averages as a reasonable approximation.
CMS uses HMRC-confirmed gross taxable income from the most recent tax year — typically PAYE wages, self-employment profits, pension income, and investment/rental income over £2,500/yr. Dividends and benefits in kind are included in some cases. CMS does NOT normally assess lump sum assets, capital, or inheritances as income unless they generate ongoing income.
Under Collect & Pay, CMS can enforce via deduction from earnings order (direct from wages), deduction from bank account, bailiff recovery, driving licence suspension, passport suspension, or ultimately committal to prison. February 2024 reforms expanded these powers and reduced the time needed to act against non-paying parents.
